Suffered a Personal Injury?
Why you should make a claim and what happens next
Most people have never had to contact a Solicitor (except for buying or selling a house) and it can be a worrying time. Ingrams offer a free interview with no obligation.
Many people believe we live in a claims culture and are indeed making a claim for anything and everything, often citing that we are getting as bad as America! However if you are off work and losing income due to sustaining an injury that wasn’t your fault who will pay your mortgage or bills?
Almost everyone pays insurance, either for a motor vehicle or, if you run a business, to cover you for accidents to your employees or members of the public. If you had a fire at home or in the office, would you submit a claim to your insurance company? Of course you would, because you paid your insurance to cover the cost of any damage – so if you are involved in a car accident and are losing pay or suffering because of an injury, what’s the difference?
When making a claim for personal injury Ingrams need to obtain information to allow a letter of claim to be sent to the responsible party and their insurance company. We ask you to provide information about the accident either by completing one of our questionnaires or we can visit you at home or you can come to our office, whichever is the most convenient.
Once we are corresponding with the responsible parties’ insurance company they will investigate the accident circumstances. If it is clear that the accident was not your fault then liability (ie. responsibility for the accident) will be admitted, and we can then proceed to value your claim.
We will arrange for an independent medical expert to prepare a report on the injuries you have sustained; the examination will take place as near as possible to your home or work address and the cost of the report will be paid for by Ingrams and later recovered from the responsible parties’ insurance company - we will not ask you to pay any money upfront.
If your injuries are severe it may be necessary to obtain more than one report. Our main aim is to obtain compensation for the pain and suffering you have sustained and to put you in a position in relation to your financial loss that you would have been in had it not been for the accident. For example if you had two weeks off work due to your injury and were not paid, we will claim two weeks loss of earnings; this can include loss of overtime and bonuses. Once medical evidence has been obtained then, with your agreement, we will negotiate settlement of your claim.
This is a basic guide to how a claim for personal injury proceeds. No accident is ever the same; however we will provide you with as much information as you require with regards to your case.
If we are successful in obtaining compensation for your losses and for the injury you sustained our costs will be paid by the responsible parties’ insurance company; we do not take any of your compensation.
If you have been involved in an accident in the past three years and wish to arrange a free interview then please contact our personal injury team or complete the online enquiry form.
