A woman who divorced her husband in 1985 is taking him to court in the hope of claiming continued yearly maintenance payouts.

Philippa Vaughan, 66, divorced David Vaughan after 18 years of marriage and had been claiming £27,000 a year until 2009.

However, deputy High Court judge Richard Anelay QC terminated these payouts in 2009 when she went to court regarding a different matter.

Ms Vaughan now claims that she has been left with a "totally inadequate" income which will cause her "undue hardship".

She will face her estranged husband at the Civil Appeal Court next week in the hope of the maintenance agreement being renewed, although Mr Vaughan will argue that he built up most of his fortune after the divorce and she should not therefore be entitled to it.

Ms Vaughan is said to be worth some £1.7 million, but maintains that much of her wealth is tied up in non-income generating assets.

Recent figures from the Office for National statistics showed that there were 121,779 marriage breakdowns in 2008, the lowest in more than 30 years.
