Electrical worker wins £40k unfair dismissal compensation

A former electrical worker has secured £40,000 in compensation for unfair dismissal.
A former electrical worker has secured £40,000 in compensation for unfair dismissal after he was asked to leave his job by his employer.

Lawrence McLoughlin had recently had problems with his heart, but had returned to work following a short absence, the Kidderminster Shuttle reports.

However, upon his return, his manager at Colton Electrical said he was no longer needed as the company was going through a difficult patch.

Mr McLoughlin opted to take his case to an employment tribunal, as he claimed that there had been little downturn in business and also pointed out that the firm had recently spent £100,000 on refurbishing its premises.

After considering the situation, tribunal judge Karen Hindmarch said Mr McLoughlin's allegations were "well-founded" and agreed that he should be paid £40,316 for redundancy pay, payment in lieu of notice and unfair dismissal.

According to DirectGov, unfair dismissal can also occur when a fixed-term contract is not renewed or when an employer forces someone to retire.
