Out-of-hours care to be reformed following clinical negligence case

Clinical negligence case prompts out-of-hours care review
The government is to introduce new regulations for out-of-hours care following an inquest into a clinical negligence case.

Health minister Mike O'Brien has committed to tightening controls over out-of-hours care by 2012, with all providers set to be registered with the Care Quality Commission and subjected to regular compliance checks.

This comes in response to an investigation into foreign locum doctor Daniel Ubani, who was accused of clinical negligence after he administered a fatal morphine overdose to a patient.

Coroner William Morris, who concluded the inquest, said the case demonstrated "lamentable" flaws in the current system of out-of-hours care provision.

Mr O'Brien concurred that major improvements are necessary in order to ensure that safe, competent care can be guaranteed to patients.

He said: "I expect all primary care trusts to act on these recommendations … It is unacceptable for any trust to fail to meet its obligations on safety and quality of care."ADNFCR-2158-ID-19599857-ADNFCR
